Punitive damage reform bill fails

Senator Tom Harman (R-Orange) has been an advocate for sensible legal reform in California for years.  This session he introduced SB 423 to help control the punitive damage system. During the Senate Judiciary Committee hearing on the bill this week, he pointed out that five states prohibit punitive damages altogether and his bill takes a modest approach of simply limiting such awards to no more than three times the compensatory damages.

There was very little discussion at the hearing on the substance of the bill or the overall legal climate in California.  It failed on a partisan vote with all democrats voting against it.
