Toxicity assessment policy

The State Water Resources Control Board (SWRCB) recently revised their “Policy for Toxicity Assessment and Control”.  The draft policy is available at:

The proposal is for numeric toxicity objectives, a standardized method of data analysis, corresponding monitoring and reporting requirements, and provisions for compliance determination which will be used for all future National Pollution Discharge Elimination System (NPDES) permits and would supersede Section 4 of the State Implementation Policy.  Even if you do not have an NPDES permit this could affect your company if you discharge to a city or county POTW (Publicly Operated Treatment Works) because this policy will affect their discharge limits.

Comments are due by Noon on August 21. Letters can be submitted by email to: (if less than 15 megabytes in total size); or by fax at: (916) 341-5620. A SWRCB hearing on the subject will also be held at 9:00 a.m. on August 21st in the Coastal Hearing room at the California Environmental Protection Agency Headquarters in Sacramento.
