Above-ground tank bill to the Governor

AB 1566 (Bob Wieckowski, D-Fremont) passed the legislature and was sent to the Governor for his signature.  While the bill revises the definition of aboveground storage tanks to include those in an underground area and redefines tank facility, it goes well beyond that and places enforcement for all of the tanks in the State under the authority of the State Fire Marshal.

These tanks have been the responsibility of California’s 83 Certified Unified Program Agencies (CUPAs), essentially local environmental health programs. Unfortunately, there has not been a uniform interpretation of the requirements to comply with spill prevention, control and countermeasure plans, or monitoring requirements or enforcement.

This bill, supported by CMTA, provides statewide consistency and one point of contact for the program.  The bill received bi-partisan support in the legislature and Governor Brown is expected to sign it.
